Terms of Service

1. Agreement to Terms

By accessing or using Cloudventory (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Operator

Cloudventory is operated by Thompson InfoSec, S.L., a Spanish limited liability company (Sociedad Limitada) registered in Spain ("we", "us", "our").

3. Description of Service

Cloudventory provides AWS resource inventory and monitoring services. The Service allows you to:

  • Connect AWS accounts for resource scanning
  • View and track AWS resources across multiple accounts
  • Receive insights and recommendations related to AWS infrastructure
  • Monitor changes to AWS resources

4. AWS Credentials and Data Handling

You understand and agree that:

  • AWS credentials provided to Cloudventory are encrypted at rest using industry-standard encryption
  • Only resource metadata is collected and stored in secure PostgreSQL databases
  • Cloudventory accesses AWS resources using read-only permissions
  • You are responsible for the accuracy and validity of AWS credentials provided
  • You retain all ownership rights to your AWS resources and data

5. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • Ensuring AWS credentials have appropriate permissions
  • Compliance with AWS Terms of Service and applicable laws
  • All activity conducted through your account
  • Promptly notifying us of unauthorized access or security incidents

6. Acceptable Use

You agree not to:

  • Connect AWS accounts you do not own or are not authorized to access
  • Use the Service to perform reconnaissance on infrastructure you do not control
  • Share account credentials or allow others to access the Service through your account
  • Use the Service for unlawful purposes
  • Attempt unauthorized access to systems or data
  • Interfere with Service availability or integrity
  • Transmit malware or malicious code
  • Reverse engineer or attempt to extract source code
  • Infringe intellectual property rights
  • Circumvent usage limits, billing, or access controls

Violation of this section may result in immediate suspension or termination without notice.

7. Subscription and Payment

Certain features require payment. By subscribing:

  • You agree to pay all fees associated with your selected plan
  • Fees are exclusive of applicable taxes unless stated otherwise
  • VAT will be charged or reverse-charged where legally required
  • Subscriptions renew automatically unless cancelled
  • Fees are non-refundable except where required by law
  • Prices may be displayed in USD for convenience; billing is processed in EUR
  • We may change pricing with at least 30 days' notice
  • Payments are processed by Stripe Payments Europe, Ltd.

8. Service Availability

While we aim for reliability:

  • The Service is provided on an "as available" basis
  • We do not guarantee uninterrupted or error-free operation
  • Maintenance or external factors (including AWS outages or API limits) may affect availability

9. Data Retention and Deletion

Regarding your data:

  • You may request account deletion at any time
  • Deletion requests are processed in accordance with applicable EU GDPR requirements
  • Personal data and stored credentials are deleted within 30 days
  • Aggregated or anonymized usage data may be retained for analytics and service improvement

10. Intellectual Property

The Service, including all original content, features, and functionality, is owned by Thompson InfoSec, S.L. and is protected by applicable intellectual property laws.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THOMPSON INFOSEC, S.L. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence or willful misconduct.

13. Indemnification

You agree to indemnify and hold harmless Thompson InfoSec, S.L. from claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

14. Export and Sanctions Compliance

You represent that you are not subject to EU, US, or international sanctions and will not use the Service in violation of applicable export control or sanctions laws.

15. Changes to Terms

We may modify these Terms at any time. Changes take effect upon posting. Continued use of the Service constitutes acceptance of the updated Terms.

16. Termination

We may suspend or terminate access to the Service immediately for breach of these Terms or for operational or legal reasons. Upon termination, your right to use the Service ceases.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain, without regard to conflict of law principles. The courts of Barcelona, Spain shall have exclusive jurisdiction.
